The Hypnobirthing Place Privacy Policy
The Hypnobirthing Place fully respects your individual privacy and we treat your personal data as confidential. Account management
Where you obtain services or products from The Hypnobirthing Place, we may use your contact details and (where applicable) payment information for the purposes of (i) providing client support, course details and training information, (ii) billing and invoicing, (iii) verifying client satisfaction (iv) maintaining our company accounts and records, (v) providing quotes that you request and information relating to products or services that are relevant to you, and (vi) to inform you of any changes to our website, services and products.
Market research and surveys
If you participate in surveys, we may use your personal data for our internal business and training purposes in order to improve our understanding of our client’s demographics, requirements, and to measure and increase customer satisfaction.
Email communications
Emails are sent directly from zoe@hypnobirthingplace.com or through a secure permission-based email system called MailChimp (see their Privacy Policy at www.mailchimp.com). When you purchase a service from me you will be invited by email to join my MailChimp email list. You have the ability to Opt-In at this point, and subsequently subscription preferences may be changed by you at any time.
We adhere to the following guidelines in relation to our email communications:
· emails will clearly identify The Hypnobirthing Place as the sender,
· emails will include our physical postal address,
· emails sent to you for marketing purposes will include an option to unsubscribe from future email messages,
· you may unsubscribe from all mailing lists, with the exception of any emails regarding legal notices or invoicing.
Phone Numbers
I may, from time to time, use your phone number to contact you about urgent changes to our planned meeting. If you do not wish me to contact you in this way, please inform me at the time of booking your consultation or workshop.
Will The Hypnobirthing Place ever share your personal data?
In order to provide our customers with services directly relating to their requests, we may put you in touch with a third party and will only ever do this at your request and with your explicit consent.
In the event that we receive requests from government departments, agencies or other official bodies, we will only disclose your information if and to the extent that we believe we are legally required to do so (for example, but without limitation, upon receipt of a court order, warrant, subpoena or equivalent).
Except as set out above, we will not disclose your personal data save where we need to do so in order to enforce our rights.
Whenever we share personal data, we take all reasonable steps to ensure that it is treated securely and in accordance with this privacy policy.
Data retention
Personal data shall only be retained for the purpose that it was intended and for a period of time deemed necessary for legitimate business purposes. This includes; providing the services or products that we supply to you, to process transactions and refunds and to comply with legal, tax and regulatory requirements. Your personal data will continue to be retained for as long as is reasonably necessary to meet our obligations.
Beyond the period that we no longer require your personal data for legitimate business purposes, we will cease to process the data. Your data will be either securely destroyed, erased, deleted or anonymised.
Browsing our Site
When you connect to the Site, we may store a log of your visit that shows the unique number your machine uses when it is connected to the Internet - its IP address. This tells us what your machine has looked at, whether the page request was successful or not and which browser your machine used to view the pages. This data is used for statistical purposes as well as to help customise the user experience as you browse the Site and subsequently interact with ABtec and our suppliers. This helps us to understand which areas of the Site are of particular interest, which pages are not being requested, and how many people are visiting the Site in total. It also helps us to determine which products and services may be of specific interest to you. We may attempt to contact you through these details if necessary, including, without limitation, when you are using the wrong paths to access the Site or are breaching restrictions on the use of the Site. We may also use this information to block IP addresses where there is a breach of the Terms and Conditions for use of the Site as detailed in this policy.

Children
The services and products that we provide are intended for purchase by persons over the age of 16. Services may only be provided to persons under the age of 16 when the young person is accompanied by a legal guardian.

We endeavour to hold all personal data securely in accordance with our internal security procedures and applicable law.

Notification of changes
This privacy policy was last updated on 11th May 2018. We reserve the right to amend or vary this policy at any time and the revised policy will apply from the date posted on the Site. You accept that by doing this, we have provided you with sufficient notice of the amendment or variation. To be aware of changes to the privacy policy, you should review this Notice periodically.
Terms and Conditions - Booking a course
You will be asked whether you consent to be contacted by the Hypnobirthing Place when you sign up to a course with us. You also agree with the following terms and conditions before booking a place on a Hypnobirthing Place Course.
1. Availability of courses
Courses must be booked in advance.
2. Orders
A booking does not constitute the creation of a contract and The Hypnobirthing Place reserves the right to decline to process a booking for any reason whatsoever. If the booking is not able to be fulfilled The Hypnobirthing Place will promptly refund all monies.
3. VAT
VAT is not applicable.
4. Participant Cancellation and exchange
The fee will be repaid promptly and in full if your baby arrives before the course, or in the very unlikely event of the course being cancelled. These are the only circumstances under which a refund will be made. - In the event that an individual session is missed, please contact the Hypnobirthing Place to see if you can catch up via a phone session or a paid private face-to-face session. - It is possible to exchange a group course for an earlier course (e.g. from May to April) if there is availability. - It is possible to exchange a course for a later course (e.g. from April to May) if 30 days notice is given before the start of the original course booked. - It is possible to transfer your course place to another couple if you are no longer able to attend
5. Course Amendment or cancellation
Course dates and times may be changed in exceptional circumstances. If the new time and date is not convenient to you, The Hypnobirthing Place will try to offer an alternative course but if one is not available you will be given a refund for the session or sessions changed. - Any session cancelled will be rescheduled if possible. If this is not possible or if alternative dates cannot be agreed, all monies paid by the client for sessions not yet taken will be refunded and no further payments will be owed to The Hypnobirthing Place. The price refunded per session not yet taken will be calculated as half the full course fee. No refund will be made for sessions already taken.
6. Intellectual property
Any recording or written material included as part of this course and all rights worldwide (including Intellectual Property Rights) relating thereto respectively are the sole property of Katherine Graves, Zoe Donkin, The Hypnobirthing Place Ltd, or others from whom such rights may be derived (whether or not protected by trademark and copyright laws) and may not be used other than for the personal use of the participant without obtaining prior written permission. The participant agrees not to record the course or any part thereof. The participant also agrees that, from time to time, The Hypnobirthing Place Ltd may take photos for sales, marketing, promotional or quality control purposes. By attending the event, the participant consents to this for the duration of the event and agree that The Hypnobirthing Place Ltd shall retain all Intellectual Property Rights arising from any resulting media.
7. Data Protection
The participant also agrees that Katharine Graves and The Hypnobirthing Place Ltd shall hold your details on file and on computer and, in accordance with the Data Protection Act 1998, you are able to view your individual file by giving not less than seven days' written notice.
8. Disclaimer
Using Hypnobirthing techniques is not a substitute for the advice of or the presence during birth or any part of pregnancy or labour of a qualified medical practitioner, midwife or obstetrician. It does not represent in fact or otherwise an alternative to appropriate medical care or for professional medical advice in any way shape or form. Any questions or doubts that you have about the use of Hypnobirthing by you or any third party in any part should be discussed by you with your medical caregiver and the safety of or the appropriateness of this programme to you or any third party whom you represent be confirmed with your medical care giver prior to undertaking the programme. Katharine Graves, the Hypnobirthing Place Ltd, its instructors or its representatives accept no responsibility for the inappropriate use of Hypnobirthing techniques or complications or harm to any third party resulting from the use of Hypnobirthing techniques as a substitute for medical advice. Hypnobirthing is intended solely as an 'aid' to 'help' increase the comfort of labour and birth and is not in any way a guarantee or promise of expected, imagined or actual outcome of the labour or birth in any way shape or form. Participation in Hypnobirthing classes in any part or in total by any person or third party is undertaken with the understanding by any persons or third party that no litigation or legal action whatsoever will be initiated or that no form of compensation or reimbursement or refund will be claimed or applied for at any time now or in the future against Katharine Graves, The Hypnobirthing Place Ltd, its instructors, or its representatives under any circumstances whatsoever.
9. Agreement
Any booking of a Hypnobirthing class assumes full and informed compliance to and agreement with all of these terms and conditions of sale. In the event of a dispute, English law pertains.
